By accessing www.fhytewell.com or purchasing any products, services, courses, workshops, educational materials, coaching services, Mapping Sessions, digital downloads, or related content from FhyteWell® LLC, you voluntarily agree to these Terms & Conditions.

If you do not agree, discontinue use of the Site immediately. If you do not agree with these Terms, please do not use the Site or any associated platforms.

FhyteWell® does not provide:

  • psychotherapy

  • clinical care through this website

Use of this Site, participation in programs, purchase of products, participation in Mapping Sessions, workshops, courses, quizzes, educational discussions, or communications with FhyteWell® does not establish a provider-patient relationship.

All medical decisions remain solely the responsibility of the user in consultation with their licensed healthcare provider.

Educational discussions regarding wellness patterns, hormones, lifestyle practices, functional wellness concepts, labs, or nervous system regulation are informational only and are not medical advice.

4. No Guarantees

We make no guarantees regarding:

  • symptom improvement

  • emotional outcomes

  • financial outcomes

  • personal outcomes

  • business outcomes

You agree not to:

All content provided by FhyteWell® is protected by intellectual property laws.

This includes but is not limited to:

Purchase of any product or program grants a limited, non-transferable, revocable license for personal individual use only.

No ownership rights are transferred.

7. Payments

All prices are listed in U.S. dollars.

Payments are processed through third-party processors such as Stripe, PayPal, ThriveCart, Kajabi, or related systems.

We are not responsible for third-party payment processor errors or outages.

8. Refund Policy

All purchases are final.

Due to the digital, educational, and intellectual property nature of our products and services, refunds are not provided unless otherwise specifically stated.

Mapping Session Clarity Guarantee

The FhyteWell® Mapping Session includes a limited clarity guarantee.

If a client believes the promised clarity and next-step direction were not reasonably provided, the client must notify FhyteWell® either:

  • before the end of the session or

  • in writing within 24 hours following the session.

A complimentary 30-minute follow-up session will first be scheduled.

If, after the follow-up session, the client still believes the promised clarity was not reasonably delivered, FhyteWell® may issue a refund.

This guarantee applies only to the Mapping Session and does not apply to any other products, programs, workshops, coaching services, or digital materials.

9. Scheduling and Rescheduling

Scheduling policies, cancellation terms, and rescheduling policies listed on booking pages, checkout pages, intake forms, or scheduling systems are incorporated into these Terms.

Failure to attend scheduled sessions may result in forfeiture of the session without refund.

10. Third-Party Platforms

FhyteWell® uses third-party platforms and tools including but not limited to:

  • Kajabi

  • Healthie

  • Squarespace

  • Zoom

  • Vimeo

  • Acuity

  • ManyChat

  • Stripe

  • PayPal

  • ThriveCart

  • ConvertKit

  • Mailchimp

  • Membership.io

  • MemberUp

We are not liable for interruptions, outages, data loss, platform failures, or technical issues caused by third-party systems.

11. Accessibility

FhyteWell® strives to maintain an accessible website experience.

12. Limitation of Liability

To the fullest extent permitted by law, FhyteWell® LLC shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of:

  • use of the Site

  • participation in coaching or educational services

  • reliance on educational materials

  • scheduling systems

  • technology failures

  • third-party platform interruptions

  • digital downloads

  • workshops

  • quizzes

  • wellness information

Use of the Site and services is entirely at your own risk.

13. Indemnification

You agree to indemnify and hold harmless FhyteWell® LLC and its affiliates, contractors, employees, agents, successors, and representatives from any claims, liabilities, damages, losses, costs, or legal expenses arising from:

  • your use of the Site

  • your violation of these Terms

  • misuse of materials

  • infringement of intellectual property

  • reliance on educational information

14. Arbitration and Dispute Resolution

Any dispute arising out of these Terms or use of the Site shall first be attempted to be resolved informally.

If unresolved, disputes shall be resolved through binding arbitration in the State of Indiana.

You waive the right to participate in class actions or jury trials to the fullest extent permitted by law.

You are responsible for consulting your own attorney regarding your rights.

15. Governing Law

These Terms are governed by the laws of the State of Indiana.

16. Changes To These Terms

We reserve the right to modify these Terms at any time.

Changes become effective immediately upon posting.

Continued use of the Site constitutes acceptance of revised Terms.
